Terms of Service

Last updated: 22/07/2026. These Terms of Service ("Terms") govern access to and use of shop.kutchina.com ("Website") and any purchase made through it. By accessing the Website or placing an order, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, please do not use the Website.

3.1 Eligibility & Account

•      You must be at least 18 years of age and capable of entering into a binding contract under the Indian Contract Act, 1872 to place an order on the Website.

•      You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Kutchina is not liable for any loss arising from unauthorized use of your account due to your failure to safeguard your credentials.

3.2 Products, Pricing & Availability

•      Product images are for representation only; actual colour/finish may vary slightly due to display/photographic settings and natural material variation (e.g., wood grain, granite pattern).

•      All prices are in INR and inclusive of applicable GST unless stated otherwise. Kutchina reserves the right to correct any pricing, description, or typographical error at any time, including after an order is placed, and to cancel such orders with a full refund.

•      Availability of products, delivery locations (pin codes), and installation services is subject to change without notice.

3.3 Orders & Payment

•      An order is deemed accepted by Kutchina only upon dispatch confirmation, not upon order placement or payment confirmation. Kutchina reserves the right to refuse or cancel any order at its sole discretion, including on grounds of suspected fraud, abuse, reseller/bulk-buying behaviour, or incorrect pricing.

•      Payments are processed through third-party, RBI-authorized payment gateways. Kutchina does not store your card/bank credentials and is not responsible for any failure, delay, or error caused by the payment gateway, bank, or network provider.

3.4 Intellectual Property

•      All content on the Website — including the Kutchina name, logo, trademarks, product designs, photographs, text, and graphics — is the exclusive property of Kutchina Home Makers Pvt. Ltd. or its licensors and is protected under applicable Indian intellectual property laws. Nothing on this Website grants you any licence or right to use such intellectual property without prior written consent.

•      You may not reproduce, republish, scrape, or commercially exploit any content from the Website without Kutchina's prior written permission.

3.5 User Conduct

•      You agree not to: (a) use the Website for any unlawful purpose; (b) submit false, fraudulent, or abusive orders; (c) interfere with the Website's security or functioning; or (d) post or transmit any defamatory, obscene, or infringing content through any Website feature.

3.6 Disclaimer of Warranties

•      Except for the express manufacturer's warranty accompanying a product, the Website and all products/services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Kutchina disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

3.7 Limitation of Liability

•      To the maximum extent permitted by applicable law, Kutchina's aggregate liability arising out of or relating to any order shall not exceed the amount actually paid by the customer for that order.

•      Kutchina shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of data, or loss of use, arising from the use of the Website or any product purchased through it, even if advised of the possibility of such damages.

•      Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.

3.8 Indemnity

•      You agree to indemnify and hold harmless Kutchina, its directors, employees, and affiliates from any claim, loss, or demand arising out of your breach of these Terms or misuse of the Website.

3.9 Force Majeure

•      Kutchina shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, strikes, transport disruptions, government action, or supply-chain shortages.

3.10 Governing Law & Dispute Resolution

•      These Terms are governed by the laws of India. Subject to the provisions of the Consumer Protection Act, 2019 (which allows filing before the consumer forum having jurisdiction over the complainant's residence), the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising from these Terms.

•      Kutchina encourages customers to first raise any grievance with our Grievance Officer (Section 5) for prompt resolution before pursuing other remedies.

3.11 Amendments

•      Kutchina may revise these Terms at any time by posting the updated version on the Website. Continued use of the Website after such changes constitutes acceptance of the revised Terms.
